Risk Evaluation and Preemption under the LCSA

On Wednesday, June 28, Gradient and Covington will host the third live webinar on Lautenberg Chemical Safety for the 21st Century Act (LCSA) implementation, “Risk Evaluation and Preemption Under the LCSA.” This session will focus on both legal and technical issues that arise from risk evaluation and risk management under the Frank R. Lautenberg Chemical Safety for the 21st Century Act (LCSA). The talks and panel discussion will highlight how agency actions may relate to and interact with risk assessment and management activities undertaken by States, other federal programs, regulatory bodies in other nations, and transnational organizations.

June 28 Speakers:

    • Alexandra Dapolito Dunn, Executive Director & General Counsel, Environmental Council of the States, will offer perspective on how states are approaching changes to and implementation of LCSA, specifically regarding balances in preemption and state legislation. 

    • Gary Guzy, Senior Counsel, Covington, and former EPA General Counsel and CEQ Deputy and General Counsel, will highlight the unique approach to accommodating and blending state and federal requirements developed so that LCSA could secure passage and how this may play out through the law’s implementation.

    • Lorenz Rhomberg, Ph.D., ATS Ph.D., ATS, Gradient Principal, will discuss LCSA’s broad mandate to consider potential risks from all “foreseeable” conditions of use, including how those risk evaluations might interact with data requirements and assessments within existing state, federal, and international programs for chemical safety evaluation.
